LICENSE AND PERMIT REVIEW/APPROVAL ISSUES:
Any business that seeks to open a store or other facility that is open to the public must go through the process of obtaining approvals from the town/city where it is located before it may legally open its doors to the community. This involves, inter alia, working with parks and recreation (for outdoor issues), law enforcement, city managers, city attorney offices and town councils. Ensuring that all the required approvals and permits are in place for the business to function without hindrance require advocacy, experience and a thorough knowledge of local laws and regulations. The Law Office f Holden Green is familiar with the requirements and procedures in Palo Alto, Menlo Park, Los Altos, Mountain View, Sunnyvale, Cupertino, Santa Clara, Alameda, Santa Cruz and San Mateo counties.
If mistakes are made in the initial application process, the required approvals may be withheld. This will require going in for appeals which are both costly and time consuming to the extent of delaying the start of the business. Ensuring that all procedures are adhered to will avoid the need for appeals. For example, for restaurants and related licensing (liquor, expansion, special operating hours and so forth) the approval of a majority of the council is required. The agenda is usually crowded and a business usually has only a few minutes to present its case before a decision is made. Success depends on upon thorough and detailed preparation of oral arguments and relevant information. Since the process is a rapid one, going into the system alone, unprepared and unrepresented is never advisable.
We also assist our clients on matters relating to code violations, sanctions, denials of renewal applications and/or permissions to expand. Although most of these issues are dealt with internally, the amount of preparation required to present a case successfully is the same as when appearing before a judge or city council.
Contact the Law Offices of Holden Green for more information on the services offered in these and related areas and for an in-office consultation with Mr. Green.
