MOTION TO RECONSIDER
From time to time a motion does not go ones way. Often times it is because the judge does not allow you to speak or get your evidence in. All is not lost. A moving party can file pursuant to Code of Civil Procedure 1008 a motion to reconsider. The motion must be filed (not heard) within 10 days. the steps are to get a date, file a notice of motion, memorandum of points and authorities, and conclusion. Attach any exhibits and file a proof of service. The filing fee is $40.00. You can even do this in a criminal action.
